These Terms and Conditions ("Terms") govern access to Inkydoop, including its website, stories, audio, images, word activities, questions, printable materials, and related services (collectively, the "Service"). Inkydoop is currently operated by an individual (the "Operator," "we," "us," or "our").
1. Agreement and adult responsibility
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. A parent, legal guardian, teacher, or other authorized adult must review and authorize use by a minor. That adult is responsible for deciding whether the Service and any particular story are suitable for the child and for supervising the child's use.
2. AI-generated content
Stories, images, narration, vocabulary, questions, answers, and explanations may be created or assisted by artificial intelligence. Content is held for human review before publication, but review cannot guarantee that every item is accurate, complete, original, error-free, or appropriate for every reader. AI output may contain mistakes, omissions, unexpected language, or similarities to existing material. Stop using and report any content that appears unsuitable.
3. Informational and enrichment use only
The Service is provided for storytelling, curiosity, and general enrichment. It is not professional educational, medical, psychological, legal, safety, or other professional advice. It does not replace a qualified educator, caregiver, or professional. Reading levels, definitions, questions, answers, and explanations are estimates and examples, not formal assessments or guarantees of learning outcomes.
4. Children and privacy
The reader experience currently requires no account and asks children not to provide names, contact details, school information, health information, precise location, or other personal information. Story-question responses remain in the browser and are not submitted by the current reader interface. The Service uses a reading-level cookie and device-local storage for theme, saved-story choices, and any analytics consent choice. If an adult allows analytics, Google Analytics may process limited usage and device information, including visited pages, approximate location, browser or device details, and interaction data. We do not intentionally send children's names, story-question answers, or advertising identifiers to Analytics, and we disable Google advertising personalization and Google Signals. Selecting an unlisted word may send that word and ordinary network request information to a third-party dictionary service. Hosting and security providers may process technical logs such as IP address, browser details, timestamps, requested pages, and errors. Mandatory privacy and children's rights are not waived by these Terms.
5. Acceptable use
You may use the Service only lawfully and as intended. You must not attempt to bypass moderation or access controls, obtain private or pending content, misuse administrator functions, probe or disrupt the Service, introduce malicious code, overload infrastructure, scrape content at scale, impersonate another person, or use the Service to harm, exploit, track, or profile a child. You must not submit secrets or personal information in any free-text field.
6. Intellectual property and license
The Service, branding, software, selection and arrangement of content, and other protected materials are owned by or licensed to the Operator. Subject to these Terms, you receive a limited, revocable, non-exclusive, non-transferable license to access the Service and use or print published story materials for personal, family, or classroom use. You may not sell, sublicense, republish, systematically extract, create a competing content library from, or use Service content to train an AI model without prior written permission. Third-party rights remain with their respective owners.
7. Third-party services
The Service depends on third parties, including cloud hosting, storage, AI model providers, speech and image services, and a dictionary service. If enabled with adult permission, the Service also uses Google Analytics for usage measurement. Their availability, outputs, security, and terms are outside our control. Links or integrations do not constitute an endorsement. Your use of a third-party service may also be governed by that provider's terms and privacy rules.
8. Availability and changes
We may modify, suspend, restrict, or discontinue any part of the Service; remove or correct content; change models or features; or impose usage limits at any time. We do not promise that the Service or any particular story will remain available, that data will be retained, or that operation will be uninterrupted, timely, secure, or error-free.
9. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Service and all content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, or suitability for a particular child. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
10. Limitation of liability
To the fullest extent permitted by applicable law, the Operator and any contributors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, revenue, goodwill, or opportunity; or claims arising from reliance on AI-generated content, third-party services, interruption, unauthorized access, or a child's use of the Service. Aggregate liability for claims relating to the Service will not exceed the greater of the amount you paid for the Service during the preceding 12 months or US $100. This section does not exclude liability that cannot lawfully be excluded, including mandatory consumer rights and, where applicable, liability for fraud, willful misconduct, gross negligence, or personal injury.
11. Responsibility for misuse
To the extent permitted by law, an adult user or organization agrees to defend and indemnify the Operator against third-party claims, losses, and reasonable costs caused by that user's unlawful misuse of the Service, violation of these Terms, or infringement of another person's rights. This obligation does not apply to a child merely using the reader experience as intended or to losses caused by the Operator.
12. Suspension and termination
We may restrict or terminate access when reasonably necessary to protect children, users, the Service, third parties, or legal rights, or when these Terms are violated. Provisions concerning intellectual property, disclaimers, liability, and disputes survive termination where legally permitted.
13. Applicable law and disputes
These Terms are governed by the laws applicable at the Operator's principal place of residence, without overriding mandatory protections available where you live. Before filing a claim, an adult user agrees to send a written description and allow 30 days for an informal resolution, unless urgent relief or applicable law requires otherwise. Nothing in these Terms limits rights that cannot be waived by contract.
14. Changes to these Terms
We may update these Terms as the Service, law, or business changes. The effective date will be revised when changes are published. Continued use after an update means acceptance to the extent permitted by law. Material changes may require additional notice or consent where applicable.
15. General terms
If a provision is unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. These Terms constitute the agreement concerning use of the Service and do not create an agency, partnership, employment, or fiduciary relationship.
16. Contact
A contact method for legal, safety, copyright, and content concerns will be published before the Service launches publicly. Do not include unnecessary personal information about a child in any report.
